The supervising attorney in your firm is not a technology whiz. He knows that e-discovery is a hot button area that is spreading at a rapid pace. He has asked that you conduct some preliminary research to brief him, in memo format, on the following areas: The different types of e-discovery in an overview context Forensic electronic discovery The jurisdictional rules (procedural and ethical) that are on point with e-discovery in your jurisdiction Consequences of poor management of e-discovery, including but not limited to spoilage Best practices to conform with state procedural and ethics rules that can be implemented in your office for proper records management and maintenance The role of all who will be involved in the e-discovery process, including but not limited to the paralegal, the attorney and the IT department. Cite on point ethical and procedural/substantive rules and law on point with your assessment and analysis. Conclude by making suggestions for a firm policy on the use of e-discovery.
