university speech

To discuss the role of the University in freedom of speech, we will use these four articles.

The first is a New York Times article that opens with a reminder that Biden promised to appoint a Black woman to the US Supreme Court and then describes some of the ways that he has been evaluating the possible justices. The next is an NY Books Daily article which describes the situation in which a law professor wrote tweets which many consider to be racially offensive on the topic. The third one is a statement from Georgetown’s Black Student Union. Finally, the last article outlines an argument about how university administrators react to offensive speech from faculty.

After you have read these articles, please answer the following questions:

(1) Do you believe that Ilya Shapiro should be fired by the Georgetown University? Why, or why not?

(2) If you were a high-achieving Black female law student in Shapiro’s class on Constitutional law, how would his tweets affect your classwork and participation? What role do you believe that your experience in his class should have the university’s decision to fire Shapiro or not?

(3) How does Erwin Chemerinsky, Dean of Berkeley Law, believe that university administrators should respond? What standards does he lay out for deciding on a response? Do you agree with his standards? Are there any others you would recommend?
